Terms of Service

1. Acceptance of Terms

By purchasing, downloading, installing, or using PortSync Engine ("PortSync," "the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not purchase or use the Software.

2. Product Description

PortSync is a self-hosted portfolio engine delivered as a Docker image. It includes App Store/Play Store sync, AI-powered content generation (BYOL model), blog engine, newsletter management, per-app support, team roles, database migration tools, and other features as described on the product page. The software is provided as a one-time purchase with no recurring subscription fees. Licenses are sold via Gumroad, Paddle, or offline purchase.

3. License Grant

3.1 What You Get

Each license key grants you a non-exclusive, non-transferable, perpetual right to deploy PortSync. Each license key is locked to one (1) domain. The tiers differ in the number of apps you can manage:

  • Starter- Up to 5 apps, 1 domain
  • Growth- Up to 15 apps, 1 domain
  • Enterprise- Up to 50 apps, 1 domain

3.2 What You Cannot Do

  • Resell or redistribute the PortSync Docker image, source code, or license key to any third party
  • Reverse-engineer, decompile, or disassemble the Software, except where permitted by applicable law
  • Share your license key with other individuals, companies, or organizations outside your team
  • Use the Software to build a competing product- i.e., a portfolio generator offered as a product or service
  • Remove or alter any proprietary notices, labels, or branding on the Software (see Section 3.4 below)

3.3 All Features Included

Every PortSync tier includes access to all features. There is no feature gatekeeping. The tiers differ only in the number of apps supported.

⚠️ 3.4 Mandatory "Powered by PortSync" Branding

The "Powered by PortSync" link/badge displayed on your portfolio is an absolute mandatory requirement of your license. You may not remove, hide, obscure, or alter this branding in any way.

Violation of this clause will result in immediate and permanent forfeiture of your license without any refund. This is non-negotiable and applies to all tiers.

4. Self-Hosting & Infrastructure

You are responsible for providing your own hosting infrastructure (server, domain, SSL certificate, database). PortSync supports Firebase, Supabase, PostgreSQL, and MongoDB. You are solely responsible for the security, backups, and maintenance of your self-hosted instance.

5. AI & Third-Party APIs

PortSync's AI features use a BYOL (Bring Your Own LLM) model. You supply your own API keys for Google Gemini, OpenAI, Anthropic, or a local LLM. Any usage of these third-party APIs is governed by their respective terms of service. We are not responsible for costs, usage limits, or policy violations incurred through your use of third-party AI providers.

6. App, Web & Chrome Store Data

PortSync syncs publicly available app listing data from the Apple App Store, Google Play Store, Chrome Web Store, and Web Apps. You represent and warrant that you have the right to use the app listings you sync (i.e., they are your apps). You are responsible for complying with Apple's, Google's, and other direct platform terms regarding the display of app store data.

7. Updates & Support

Your one-time purchase includes:

  • Lifetime updates to the PortSync Docker image for your purchased major version
  • Community support via the support form
  • Priority support for Enterprise tier customers

We aim to provide regular updates, but we do not guarantee a specific update schedule. Major version upgrades (e.g., v1 → v2) may be offered as separate purchases at a discounted rate for existing customers.

💰 8. Refund Policy

8.1 14-Day Money-Back Guarantee

We offer a 14-day money-back guarantee from the date of purchase. If you are not satisfied with PortSync for any reason, you may request a full refund within 14 days of your purchase date.

8.2 How to Request a Refund

Email us at portSync@praveenojha.com with the subject line "Refund Request" and include:

  • Your Gumroad order email or receipt number
  • A brief reason for the refund (optional, but helps us improve)

8.3 Refund Processing

  • Refunds are processed within 5–7 business days via Gumroad or Paddle (depending on original payment method)
  • For offline purchases, refunds are processed via bank transfer within 7–10 business days
  • Once refunded, your license key will be deactivated and you must stop using the Software
  • Refunds are issued to the original payment method

8.4 After 14 Days

After the 14-day window, refunds are granted only at our discretion for exceptional circumstances (e.g., a critical, unresolved bug that renders the software unusable). Please contact us to discuss any issues before requesting a late refund- we're happy to help troubleshoot.

8.5 Non-Refundable Situations

  • License key already shared with multiple parties in violation of these Terms
  • Refund requested after 14 days without an exceptional circumstance
  • Issues caused by third-party services (hosting providers, AI APIs, database providers) that are outside our control
  • License forfeited due to removal of "Powered by PortSync" branding (see Section 3.4)

9. Warranty Disclaimer & No Guarantee

NOVASYNC IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. THE SOFTWARE COMES WITH ABSOLUTELY NO GUARANTEE. USE OF THE SOFTWARE IS ENTIRELY AT YOUR OWN RISK. WE DO NOT GUARANTEE UPTIME, DATA INTEGRITY, COMPATIBILITY WITH YOUR INFRASTRUCTURE, OR FITNESS FOR ANY PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PRAVEEN OJHA OR NOVASYNC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE.

11. Termination

We reserve the right to deactivate your license key if you violate these Terms, including but not limited to: redistributing the Software, sharing your license key, or removing the mandatory "Powered by PortSync" branding. Termination due to branding removal is immediate and without refund. Upon termination, you must cease all use of the Software and destroy any copies in your possession.

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes, claims, or legal proceedings arising from or related to these Terms, the Software, or your use of PortSync shall be subject to the exclusive jurisdiction of the courts located in Varanasi, Uttar Pradesh, India. By purchasing or using PortSync, you agree to submit to the personal jurisdiction of these courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Software after any modifications constitutes acceptance of the revised Terms.
